Does your CQC rating require improvement?

If your rating is inadequate or requires improvement, then we are here to help and support you, as the provider, through what is often a stressful and painful process for everyone involved.

CQC enforcement has divided into three distinct areas:

  1. Requiring improvement
  2. Forcing improvement
  3. Holding provider to account

Requirements act as a prosecution to enforcement action, and usually a report from a provider including plans, actions, timescale are all set out detailing how they, the provider intend to improve the regulated activity they are concerned about.

The use of conditions is more and more widely used by CQC to ensure compliance with registration requirements and they can improve, may or remove conditions of registration. They use civil enforcement powers to do this including warning notices.

Prosecution is their last resort and it aims to hold providers to account for serious failings where it is likely to lead to harm or significant risk of harm to service users or residents.

Rather like H.M.R.C. until you fall foul of their regulatory duties, you may be unaware of the legal powers they have at their disposal. It is wise to be up to date on their enforcement action powers which is published on their Enforcement Policy document available from their website.
